Terms of service

NOTE: CTO, as indicated in some product descriptions, stands for "Order on Request" and/or means that the product does not fall under the general terms and conditions for consumer purchases. Products marked with CTO are subject to our terms and conditions for business customers (not consumers) and are therefore generally excluded from the right of return. In addition, these products may have a longer delivery time and higher delivery costs than stated online. When ordering BaA products, the customer will be informed accordingly, and the specification will be confirmed before the order is accepted.

1) The Offer

Price changes, errors, printing mistakes, and technical changes are reserved. Colours may differ from the original colours due to printing technology. All deliveries and services are provided solely based on these terms and conditions, even if they are not expressly agreed upon again. Any differing business, purchasing, and/or order conditions of the buyer are hereby rejected. Deviations from these conditions are only effective if we confirm them in writing.

2) How do we deliver?

By UPS to your delivery address; shipments to PO boxes, packing stations, and poste restante shipments are not possible. Orders received by us from Monday to Friday by 2 pm will be shipped on the same day - provided the goods are available; we generally keep 90 to 95% of our items in stock. Due to fluctuations in demand and delivery delays from manufacturers, longer delivery times may be expected in exceptional cases. If an item is not available, you will receive an order confirmation with the expected delivery date.

3) Shipping Costs

The shipping costs within Germany are €9.95. Excluded from this are orders that have to be delivered as bulky goods. An additional €7.00 bulky goods surcharge applies here. For cash on delivery shipments, an additional €7.00 cash on delivery fee applies. We deliver to Austria at a flat rate of €9.95. For all other countries, the shipping costs are calculated based on weight and country - you will receive a cost estimate from us for this.
Subsequent deliveries are free of charge.
This does not apply to international orders.

We also deliver on request by courier, overnight, early morning, Saturday, or Sunday and public holiday delivery domestically and internationally. Please inquire about details and additional costs with your order. Orders will only be delivered if all previous deliveries have been paid for, or are not due for payment for more than 10 days.

4) How do you pay?

For deliveries within Germany:

5) For deliveries abroad:

For deliveries to countries within the European Union, we need your VAT ID number to deduct the German VAT. Otherwise, the statutory VAT must be charged. For countries outside the European Union, the German VAT does not apply. The local import VAT, plus customs clearance and customs fees, will be added.

Due to our tight calculation, we ask for your understanding that discounts cannot be deducted. We reserve the right to refuse delivery against an open invoice without giving reasons. In case of doubt, we check the identity and creditworthiness of the orderers with the help of Schufa, Creditreform, and other suitable companies.

6) Product Warranty

Our manufacturers and suppliers guarantee the quality of their products. In addition, we ensure the fulfilment of your warranty claims and any necessary service for one year from the invoice date.

7) Right of Withdrawal for Consumers

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us (grafipress GmbH, Gablonzer Str. 28 a, 76185 Karlsruhe, Telephone 0800 776 2000, Email info@grafipress.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax, or email). You may use the model withdrawal form attached to your order, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer. 

Obligation to Accept/Refusal to Accept

For goods ordered on a binding basis, the customer is obliged to accept them. For custom-made products, there is a general obligation to accept the ordered production if it is a custom-made product or goods specifically tailored to customer requirements. We try to avoid overproduction or underproduction as much as possible. A return of overproduced items by the seller is not possible.
We reserve the right to take legal action. 

For contracts for the delivery of audio or video recordings or computer software in a sealed package, the right of withdrawal expires if the seal is removed after delivery.

8) Transport Damage, Obvious Defects

Please check the shipment immediately upon receipt for completeness and integrity. If the package is damaged, please report it to the delivery service immediately. In this case, please contact us. If you assign your claims against the carrier to us in writing, we will immediately replace the damaged items. Please also report obvious defects to us immediately, but no later than 2 days after delivery. We will remedy the defects or provide you with a replacement. Please keep the goods, including the original packaging, ready for us in any case.

9) Data Protection

To process your order, we store your address and order-related data on our computer system. We are committed to comprehensive protection of your data in accordance with the provisions of the Federal Data Protection Act. Upon request, we will delete your stored data. Please inform us briefly in writing.

10) Retention of Title, Jurisdiction

The delivered goods remain the property of grafipress GmbH until full payment of our total claims. In the event of default in payment, we are entitled to charge default interest at a rate of 5% above the base rate announced by the Deutsche Bundesbank and to initiate legal dunning proceedings.
The place of performance and jurisdiction for both parties, buyer and seller, is Karlsruhe. If any provision in these terms and conditions or any provision within the framework of other agreements is or becomes invalid, the validity of all other provisions or agreements shall not be affected.
